Continuing a growing trend in nullification of unconstitutional actions by the federal government, the Sheriff of Linn County, Oregon, has sent a letter to Vice President Biden saying he will refuse to enforce federal regulations “offending the constitutional rights of [his] citizens.”
But even more astounding — and commendable — in this age of wimpy public officials, he states that he will not permit “the enforcement of any unconstitutional regulations or orders by federal officers” within his jurisdiction.

Sheriff Mueller’s Letter to Vice President Biden
Dear Mr. Vice President,
I am Sheriff Tim Mueller, elected twice by the citizens of Linn County Oregon who have entrusted me with a noble cause: to keep them and their families safe. My deputies and I take that responsibility very seriously and, like you, have sworn to support the Constitution of the United States. I take that oath equally as serious as protecting our citizens. I have worked for the people of Linn County for over 28 years as a member of the Linn County Sheriff’s Office as well as serving three years active duty as a Military Police Officer in the US Army, where I also swore a similar oath.
In the wake of the recent criminal events, politicians are attempting to exploit the deaths of innocent victims by advocating for laws that would prevent honest, law abiding Americans from possessing certain firearms and ammunition magazines. We are Americans. We must not allow, nor shall we tolerate, the actions of criminals, no matter how heinous the crimes, to prompt politicians to enact laws that will infringe upon the liberties of responsible citizens who have broken no laws.
Any federal regulation enacted by Congress or by executive order of the President offending the constitutional rights of my citizens shall not be enforced by me or by my deputies, nor will I permit the enforcement of any unconstitutional regulations or orders by federal officers within the borders of Linn County Oregon.
In summary, it is the position of this Sheriff that I refuse to participate, or stand idly by, while my citizens are turned into criminals due to the unconstitutional actions of misguided politicians.

Other Recent Examples of Gun Ban Nullification
Kentucky Sheriff Denny Peyman announced recently: “My office will not comply with any federal action which violates the United States Constitution or the Kentucky Constitution which I swore uphold.”
Wyoming has introduced the Firearms Protection Act, which if passed would impose jail terms for federal officials enforcing or attempting to enforce federal regulations pertaining to firearms and accessories that are manufactured and remain in that state.
Similar laws have already been passed in Tennessee, South Dakota, Idaho, Utah, Arizona, and Alaska. Twenty-one other states have introduced such bills in their legislatures, but have not enacted them.
All of these laws are premised on the constitutional limitation of the federal government’s power to regulate commerce within the boundaries of the states. The US Constitution grants the federal government the power to regulate interstate commerce, but not intrastate commerce. So if a gun is manufactured in a state for sale only in that state, the federal government has no power to regulate it.

We are starting to get some momentum with local officials on this subject. Here in Texas there are a few Sheriffs giving the same stance to protect our second amendment rights.

I’ll bet he wouldn’t allow a non-violent felon who has served his time to own a gun. I’ll bet he’d arrest a 20 year old for carrying a pistol. I’ll bet he’d arrest anyone who had a pistol without a permit and background check, fingerprints, etc.
The reason we have this problem today is because CONservatives compromised our rights away in 1968, and then again at the original "Assault Weapons" ban.
What part of "shall not be infringed" don’t you understand? You don’t need a permit to petition Congress, you don’t need a background check to preach a sermon, you wouldn’t allow for a "three day waiting period" to exercise your right to free speech, but the NRA and the CONservatives have gone along with all these.

Yeah for South Dakota and other states already having such laws. And hell yeah for LEO’s that know their place in service TO the law abiding citizens and NOT over those citizens. Impeach!!! By force if neccessary.
None of them are refusing any federal gun bans. You can’t refuse an illegal or unconstitutional order. You just ignore them and report them. It is illegal and unconstitutional for the sociopathic morons to attempt to issue such orders. We need to shine a light on every rat at the top of the food chain! Hold them accountable! Prosecute them!
